Gun Control Timeline In The US: Did It Actually Work Or Just Violate The Constitution?

Today, all we hear is more gun control, but does it work and when did the United States begin to “control” guns?
In 1837, the first gun control law was written in Georgia banning handguns. The Supreme Court threw the case out based upon the reading of the Second Amendment.
The next time guns were banned was in 1865 when the Southern Democrats adopted the “black codes,” which forbid black persons from possessing firearms.
Then the next gun control act came in 1927 when Congress banned the mailing of concealable weapons.
During the roaring 1920’s and into the 1930’s, machine guns were widely used by the mafia and other criminals.
In 1934 the National Firearms Act was passed regulating the manufacture, sale and possession of fully automatic firearms like sub-machine guns.
These laws were the result of certain actions by criminals as are the laws of today, but let us take a look at the next time gun control laws were implemented.
“The Federal Firearms Act of 1938 places the first limitations on selling ordinary firearms. Persons selling guns are required to obtain a Federal Firearms License, at an annual cost of $1, and to maintain records of the name and address of persons to whom firearms are sold. Gun sales to persons convicted of violent felonies were prohibited.”
This is the first time “convicted felons” were banned from buying guns of any sort, but that did not stop any felon from stealing or lying or doing anything to obtain a gun. Let us take a break from the gun laws here and set up an imaginary circumstance.
Let’s say, for the sake of argument, that a man uses a Dodge Ram 1500 truck to run into a schoolyard killing many children. According to many today, we must ban that truck as it was used to kill children. This may sound stupid but this is almost what is being proposed concerning guns.
Any mass killing, no matter how it is done is horrible and extremely wrong. But when we run on pure emotion, we do not see that the ideas that we are yelling about don’t actually make any sense. To say we need to ban a weapon because it was wrongly used in the commission of a crime would be very much like the circumstance shown above. We do need to protect our children in the schools and that is of utmost importance. We do not need to place placards on our schools stating, “This school is a Gun Free Zone.” That is like a written invitation to a nut that he has no resistance when he goes into the school with a gun or any other weapon.
Getting back to the “gun control laws,” we see the following.
“The Gun Control Act of 1968 – was enacted for the purpose of “keeping firearms out of the hands of those not legally entitled to possess them because of age, criminal background, or incompetence.” The Act regulates imported guns, expands the gun-dealer licensing and record keeping requirements, and places specific limitations on the sale of handguns. The list of persons banned from buying guns is expanded to include persons convicted of any non-business related felony, persons found to be mentally incompetent, and users of illegal drugs.”
These “laws” were expanded to include age, criminal background, incompetence, those convicted of any non-business related felony, persons found to be mentally incompetent, and users of illegal drugs. Keep that in mind because that 1968 law, if it were properly applied, may have stopped the Parkland school shooter from buying any weapon. However, even with these laws, it did not stop the abuse of guns to kill people as most criminals get their weapons from the same place they get their drugs.
It was not until 1972 that the Bureau of Alcohol Tobacco and Firearms was created to enforce the “gun control” laws that were in effect. Before 1972, the FBI and local and state police would be the enforcers of the gun laws. Even with these new laws that infringe upon the rights of law-abiding citizens, they still had many cases of murder by various weapons.
“The Armed Career Criminal Act increases penalties for possession of firearms by persons not qualified to own them under the Gun Control Act of 1986.
The Firearms Owners Protection Act (Public Law 99-308) relaxes some restrictions on gun and ammunition sales and establishes mandatory penalties for use of firearms during the commission of a crime.
The Law Enforcement Officers Protection Act (Public Law 99-408) bans possession of “cop killer” bullets capable of penetrating bulletproof clothing.”
In 1986, we see an increase in penalties for the use of firearms by persons not qualified to own them, but these acts did not stop killings and, once again, they create laws that have no real affect upon those who wish to hurt or kill others.
We have to wonder just what will it take to stop the killings, but the answer is one not accepted by those who oppose the ownership of guns. It is more guns in properly trained hands and the total elimination of “Gun Free Zones,” which would be a deterrent to criminals who believe they can do as they please with whatever type of weapon they have because no one in those zones have a way to fight back once the criminal begins their rampage under the current circumstances!
“The Crime Control Act of 1990 (Public Law 101-647) bans manufacturing and importing semiautomatic assault weapons in the U.S. “Gun-free school zones” are established carrying specific penalties for violations.”
This “Crime Control Act of 1990″ produced all the invitations for shooters to walk into any “GUN FREE ZONE” they wish, knowing they could shoot anyone they wished and walk out without anyone doing anything about it. That simply does not make sense to show with a placard that the entire area is a “Gun Free Zone.” Criminals and mentally deranged people see those signs and then know they can go in and shoot people like targets in a game. And what kind of penalties are imposed upon a shooter walking through a school with no reaction from anyone other then hiding in classrooms with doors closed. The answer is to eliminate the restrictions on American citizens’ rights that are supposed to be protected in the Second Amendment and remove any say so from the federal government with regards to education.
Now, we come to a time just after President Ronald Reagan was shot and the Brady Handgun bill was passed and “assault weapons” were banned. Those laws are shown below.
1994 – The Brady Law and Assault Weapon Ban
“The Brady Handgun Violence Prevention Act imposes a five-day waiting period on the purchase of a handgun and requires that local law enforcement agencies conduct background checks on purchasers of handguns.
The Violent Crime Control and Law Enforcement Act of 1994 prohibited the sale, manufacture, importation, or possession of a number of specific types of assault type weapons for a ten-year period. However, the law expired on September 13, 2004, after Congress failed to reauthorize it.”
Here, we see that handguns went through certain requirements to obtain and the Violent Crime Control and Law Enforcement Act of 1994 prohibited “specific types of Assault type weapons.” This was done for 10 years and one has to wonder just how many lives were saved by having a ban on certain alleged “assault weapons.” During the ten-year ban on these so-called assault weapons they had some 79 killed and 147 wounded during the ban on assault weapons. This includes the Mass shooting at Columbine High School.
The bans on any sort of guns are not a protection against a nut that may get guns and if not guns, other types of weapons.
We see the term “assault weapon” used a lot with any sort of weapon people do not understand. So, what is an “assault weapon”?
First, we should look at the origin of the term “assault weapon” and understand just what it means.
An Assault Weapon is – a firearm, which can selectively change from fully automatic to semiautomatic and uses a large magazine combination for use in combat. This can apply to various types of weapons, grenade launchers, very large caliber rifles, and a host of semi and fully automatic firing weapons.
The term “assault rifle” is a term that has been generally attributed to Adolf Hitler.
“The term assault rifle is generally attributed to Adolf Hitler, who for propaganda purposes used the German word “Sturmgewehr” (which translates to “storm rifle” or “assault rifle”), as the new name for the MP43, subsequently known as the Sturmgewehr 44 or StG 44. However, other sources dispute that Hitler had much to do with coining the new name besides signing the production order. The StG 44 is generally considered the first selective fire military rifle to popularize the assault rifle concept. Today, the term assault rifle is used to define firearms sharing the same basic characteristics as the StG 44.”
How many people will be able to state accurately that Adolf Hitler, the leader of the German Nazi Party, coined the term “assault rifle”? Does this mean that every time we say an “assault rifle” we are extending the Nazi propaganda machine? We should read all the ideas out there and where they come from. In this instance, some in the United States have called weapons used for hunting “assault rifles” just to ban them. We have to take time to allow our emotions to settle because when we make a move on emotions only, we do not make rationale decisions.
As a nation, we do have a problem with death by gunfire. But should we cause those who abide by the Second Amendment to suffer due to the ill actions of criminals? We do feel very deeply for those families that lost loved ones due to the actions of the deranged individual in Florida, but we also have to see the side of the legal weapon owners that love types of rifles that are wrongly called “assault weapons” simply because they look like an army rifle. We know that nearly every weapon in the world today could be and, in most cases, have been used as weapons of armies. That does not make them “assault weapons.”
Gun control does not protect anyone but criminals. We have to arm teachers to protect our children and remove the “Gun Free Zone” placards and replace them with ones that warn any criminal that they will be fought on the same line of action should they decide to try and enter an armed school.
Israel had big problems with terrorists shooting up their children and schools. They did not try to ban the weapons. Instead, they armed the teachers and let everyone know weapons were on school property and used by teachers. They do not have attacks on their children anymore.
WE THE PEOPLE should do the same and use our teachers to protect the children. Veterans, such as myself, would do this for little or nothing to ensure our children do not get harmed by criminals intent on hurting them.
Let us all settle down and find out how we can arm our schools to keep the deranged idiots out. It can and has been done. So, it is not an undoable thing.
To those who have felt the deep pain of losing a loved one or a dear friend, we pray to God to ease your pain. We also pray to God that we may help you find a way to stop this madness. I, for one, would be happy to sit with my weapon and guard the children of any school. It would be an honor as a great number of veterans and police would also be happy to do.
